EU RESIDENCE PERMIT IN HUNGARY

In this article, we will mention the EU residence permit application in Hungary, detailing Blue Card requirements and process.

WHO CAN ENJOY THE BENEFITS OF EU RESIDENCE PERMIT?

The citizens of the European Union and the spouses of Hungarian citizens do not need a residence permit. However, The citizens of the European Union need to apply for a Registration Card and an Address Card if their stay exceeds 90 days (in 180 days).

According to The Treaty On European Union, EU citizens are allowed to look for a job in another EU country or work there without needing any work permit or reside there for that purpose or stay there even after employment has finished and enjoy equal treatment with nationals in access to employment, working conditions and all other social and tax advantages. It means the citizens of the European Union have the right to free movement in the EU Member States.

EU citizens who move to another EU country to look for job opportunities (under certain conditions), Family members, EU nationals who return to their country of origin after having worked abroad, EU citizens working in another EU country.

EEA nationals mean the citizens of the Member States of the European Union – non-Hungarian citizens – and citizens of any State that is a party to the Agreement on the European Economic Area.

The Application of Registration card is submitted to the Office of Immigration and Nationality in the place of residence.

NECESSARY DOCUMENTS FOR EU RESIDENCY:

The Registration card is valid for an unlimited period or until the EU citizen leaves Hungary for a long period or permanently.

The Address card is sent to the client’s home within some weeks. 

Non-European Union citizens family members of European Union citizens need to apply for residence permit if their stay is more than 90 days. They have to apply within 90 days of entering Hungary. The permit will be valid for 5 years.

The European Union citizens and their family members are entitled to stay in Hungary after 5 years and they can apply for a permanent residence permit.

  • Proof of employment
  • Proof of accommodation
  • Proof that the applicant can cover their own and their family’s costs during their stay in Hungary

EC PERMANENT RESIDENCE PERMIT APPLICATION IN HUNGARY

The EC permanent residence permit can be issued to a third-country national who wants to stay longer time in Hungary.

The third-country national can get it, if he/she has a place of abode in Hungary and the subsistence is ensured. Also he or she will need a comprehensive healthcare insurance or sufficient financial resources for healthcare services. He or she can the permit if he/she is lawfully resided in Hungary continuously for at least the preceding five years before the application was submitted or who was issued an EU Blue Card (seen below), and who has lawfully resided in Hungary continuously for at least the preceding two years before the application was submitted; and who has lawfully resided in any of Member State of the European Union continuously for at least five years.

According to the 2007.II. Act. 38§ 2,a, EC Permanent Residence Permit can not be issued to a third-country national who is residing in the territory of Hungary in order to pursue studies in an institution of higher education or vocational training.

This is a work- and residence permit for non-EU/EEA nationals. It provides comprehensive socio-economic rights and a path towards permanent residence and EU citizenship.

HOW TO APPLY FOR A BLUE CARD?

The client needs to have:

  • valid work contract, binding job offer for highly qualified employment with a duration of at least 1 year;
  • meet the minimum salary threshold in the Member State concerned;
  • for regulated professions with documents
  • for unregulated professions with documents
  • present a valid travel document, (visa, if necessary), and a valid residence permit or a national long-term visa (if appropriate)
  • a proof of sickness insurance (or a proof of having applied for it)

MINIMUM SALARY REQUIREMENTS FOR BLUE CARD APPLICATIONS

The gross annual salary resulting from the monthly or annual salary specified in the work contract or binding job offer must be equal to or higher than the relevant salary threshold defined by the EU Member State.
For 2020, Hungary set the minimum salary threshold at: 5,845 euros per year (161,000 Hungarian forints/month)

VALIDITY PERIOD OF THE BLUE CARD

The Blue Card is issued for a period of at least one year and up to four years.
